Cross-Border Drug Crime Defense in China
A Complex Appeal Before the Guangdong High People's Court
Lawyer Mark represented a foreign defendant in second-instance proceedings involving allegations of drug smuggling, trafficking and transportation, with an exceptionally large quantity of drugs.
The evidence crossed countries, participants and communication channels: WhatsApp and WeChat conversations, international payments and USDT transactions, allegations of overseas instruction in drug separation and purification, meetings, handovers, witness statements and interrogation records.
The challenge was the defendant's individual role. Co-defendants shifted responsibility, some witnesses had connected interests and accounts changed. Communications, finances and oral evidence, including adverse material, required careful comparison.
The appellate work focused on supportable challenges, inconsistencies, attribution of responsibility and arguments about the individual role and sentence. It illustrates detailed, evidence-led preparation in serious international criminal defense.
The Guangdong High People's Court dismissed the appeal and upheld the first-instance judgment. The death sentence with a two-year reprieve remained in place.
